Arrest Made in Bonners Ferry Homicide

IDAHO STATE POLICE NEWS RELEASE

Please direct questions to the District Office

Detectives with the Idaho State Police and the Bonners Ferry Police Department have arrested a man in connection with the March 12th shooting death of Brian Drake.

Arrested: Daniel L. Moore, 63, of Bonners Ferry

Charge: Murder, 2nd degree (F)

Detectives made the arrest late Thursday afternoon, August 28 after an investigation involving multiple agencies and several tips from the community. The suspect was arraigned on the above charges this morning in the Boundary County Courthouse. He remains in the custody of the Boundary County Jail.

During the investigation, detectives worked closely with the Boundary County and Kootenai County Prosecutor's Offices, and uncovered compelling evidence, in addition to what they believe is a motive for the shooting. To avoid interfering with judicial proceedings, that information is not available for release from law enforcement at this time.

"Our interest from the very beginning of this investigation was justice for the victim's family," said Captain John Kempf of the Idaho State Police District 1 in Coeur d'Alene. "The community was also compelled by the tragedy of this case. ISP detectives are extremely grateful to the individuals who came forward with information that was helpful in moving this case forward."

ISP and Bonners Ferry investigators also appreciate the assistance of the FBI Violent Crimes Task Force from Coeur d'Alene, the ATF based in Missoula, Montana, the Coeur d'Alene Police Department, Kootenai County Sheriff's Office, Boundary County Sheriff's Office and the Lincoln County Sheriff's Office in Montana.

Call of Shots Fired: The evening of March 12, 2020, Bonners Ferry officers along with troopers from the Idaho State Police responded to a call of shots fired on the 6800 block of Main Street in Bonners Ferry. When they arrived, they found Drake, 45, deceased in his business office. The investigation revealed he died as the result of a gunshot wound. Idaho State Police detectives assumed the lead in the investigation in early April at the request of the Bonners Ferry Police Department. The two agencies have worked closely together throughout the investigation.

The victim of the shooting, Dr. Brian Drake was a Chiropractor who practiced in both Hayden and Bonners Ferry. He left behind a wife and four children.

###

The following statement is being released by the Idaho State Police at the request of the Drake family:

As Brian's loved ones, we were devastated to hear news of his senseless murder. As a Chiropractor, he loved his patients and he loved serving people and helping the people of Northern Idaho. He brought joy and laughter to those around him. He had a tremendous heart, and his loss has wrought a tremendous hole in our hearts. We will never understand the senselessness of the loss of Brian's life - a life that brought so much joy, meaning, companionship, and love to others.

We are grateful to the law enforcement officials - and especially the Idaho State Police and the Bonners Ferry Police - who worked tirelessly and diligently to uncover the truth. Still, those efforts cannot change the reality for Jennifer, Brian's children, or his parents and siblings. Brian's death has left a void in their lives and the community as a whole. His children will grow up without the caring father who was their rock and champion. His bride will not grow old with him, sharing the joys and burdens of raising their children together. We all remain devastated and pray for justice.

We appreciate the respect for our privacy at this time.

This morning was the second time in two days Bundy has been arrested by troopers on the above charges.

The No Trespass Notice was personally served on Bundy by the Director of the Idaho Department of Administration and Idaho State Police Troopers after Bundy arrived in the gallery of the Idaho Senate this morning. On August 17th, 2020 at 3:13 pm, the Idaho State Police responded to a non-injury, blocking crash involving a semi-tractor and trailer on I90 at milepost 63, near Wallace. Ramandeep Singh, 25, from Surrey, British Columbia, was traveling westbound on I90, driving a white 2018 Freightliner Tractor, pulling a trailer that was hauling a 50,000 pound machine used for refrigeration. Singh entered the corner at a speed too fast for the weight of his load which caused the load to shift and break off the trailer. The machine came to rest on the center barrier. The load caused the truck to overturn onto the drivers side. Singh was not injured and was wearing his seatbelt. One lane of both eastbound and westbound I90 were blocked for approximately 3 hours. Currently there is partial blockage of the eastbound and westbound fast lane due to the machine still being on the barrier and removal is underway at this time. There were no equipment failures located on the semi-truck. Investigation continuing.

ISP: Extra DUI Patrols are out in force through Labor Day

Troopers with the Idaho State Police want drivers to know that extra patrols are out in force today through Labor Day focused on finding DUI drivers.

The goal of the extra patrols is to increase safety on Idaho's roadways by reducing the number of DUI related crashes.

"We know strong enforcement of impaired driving laws is a major factor in reducing DUI related deaths," said Idaho State Police Trooper Scott Bolen.

"It's tough to tell what all we prevent, but we know families are together today because of strong DUI enforcement and that's why we do it." Said Trooper Bolen.

Because driving impaired continues to be a behavior that causes serious and fatal crashes, Idaho State Police are proud to be part of a statewide education and enforcement campaign meant to keep Idaho families and Idaho's visitors safe on the roadways as the busy summer travel season comes to a close.

Stats on the deadly impact of driving impaired:
- In 2019, DUI fatalities increased by nearly 27% across Idaho, according to the ITD Office of Highway Safety;
- Approximately one-third of all traffic crash fatalities in the US involve drunk drivers, according to the National Highway Traffic Safety Administration (NHTSA);
- In 2018, 10,511 people were killed in DUI crashes; that's one person every 50 minutes, according to data from NHTSA.

During the 2017 Labor Day Holiday period (data from NHTSA):
- 37% of drivers who died were drunk at the time of the crash;
- 45% of drivers 21 to 34 years old who died were drunk at the time of the crash;
- 79% of drunk-driving fatalities occurred at night.

What can you do? Being a responsible driver is simple: if you are drinking, do not drive:
- Plan your safe ride home before you start the party, choose a non-drinking friend as a designated driver;
- If someone you know has been drinking, do not let that person get behind the wheel. Take their keys and help them arrange a sober ride home;
- If you drink, do not drive for any reason. Call a taxi, a ride-hailing service, or a sober friend;
- If you're hosting a party where alcohol will be served, serve non-alcoholic beverage options and make sure all guests leave with a sober driver; and
- Always wear your seat belt - it's your best defense against impaired drivers.

If you see an impaired driver on the road, call *477(*ISP) or call 911. Your actions could help save someone's life.

Funding for extra traffic patrols is provided by a grant from the Idaho Transportation Department Office of Highway Safety through the National Highway Traffic Safety Administration.

On August 1, 2020, at approximately 9:56 p.m., the Idaho State Police were dispatched to a vehicle crash on U.S.20 near milepost 311, North of Idaho Falls. When Troopers arrived minutes later, they found a 2012 Chevy Impala on its top near the right-way fence by a canal. The driver was not located.

ISP Troopers were joined by members of the Idaho Falls Fire Department and Bonneville County Sheriff's Office in searching for the driver. Rescuers searched the canal and surrounding fields using a thermal imager and a grid search. The fire department's aerial boom ladder with flood lights assisted rescuers in further checking the canal and the surrounding fields. Those efforts failed to locate the missing driver.

Continuing the effort to locate the driver, an ISP Trooper later went to Rigby to the residence of the vehicle owner. The Trooper returned a second time. Each time, no one appeared to be at the home.

The Rigby Police Department was notified of the incident and on August 6th the vehicle owner was entered as a missing person.

On August 11th, in the early morning hours, Troopers went back to the crash scene. Again, the Idaho Falls Fire Department assisted in searching the canal. Later in the morning, ISP Detectives joined patrol Troopers and used four wheelers and a drone to again search the area including the canal. Still, the missing driver was not located.

On August 12th, in cooperation with the missing man's family, a team with Bonneville County Search and Rescue was deployed. Thanks to their dedication and hours of searching, a body matching the description of the driver was located in the canal approximately one mile downstream from the crash scene. The body was found in a section of the canal with swift moving water and the individual was hidden in the thick brush and Cottonwood trees. The Bonneville County Coroner was contacted and the body was removed by Coroner's office personnel.

The Idaho State Police share our sincere condolences with the involved family. We're grateful to the work and expertise of the Bonneville County Search and Rescue team and to the Idaho Falls Fire Department and the Bonneville County Sheriff's Office for help in this incident.

As always, in cases with a profound impact on a family or a community, investigators will thoroughly review each step taken to see what lessons may be learned and applied in the future. We live in a community where first responders work closely together with great care for the welfare of those we serve.

ISP supervisors from the Idaho State Police District 6 office in Idaho Falls met with the involved family prior to this public release.

This incident and crash remain under investigation.

UPDATE: 302 Citations Written during Troopers Focus on Seat Belts

Idaho State Police joined law enforcement partners throughout the state in a recent focus on seat belt education and enforcement. Between July 25 and August 7, ISP Troopers wrote 302 citations to motorists found not wearing a seat belt.

Troopers hope the focused enforcement reminds motorists to take responsibility for their own safety by buckling up.

"Seatbelts are the quickest and easiest way to save a life while driving a motor vehicle," said Trooper Max Mohr of ISP District 1 in North Idaho.

"Seat belts restrain your body inside the vehicle during a rollover and work in tandem with your vehicle airbags to protect you during impact. I have personally seen the amazing lifesaving effects of wearing a seat belt in several vehicle rollovers. Unfortunately, I have also witnessed several, not so lucky motorists who decided not to take a brief second to click their seat belt. I strongly encourage everyone to buckle their belts to protect themselves and their family."

Idaho State Police Troopers enforce safety restraint laws every day on Idaho's roadways. Troopers appreciate the value of multi-agency enforcement efforts that provide additional education and incentive for motorists to shift to safer driving behaviors.

Enforcement of Idaho's seat belt law is considered a secondary violation as drivers must be stopped for suspicion of violating another law. Still, as emergency responders like Trooper Mohr know very well, the consequences of not wearing seat belts can be devastating to families.

Data on the Value of Seat Belts: In Idaho, seat belt use is lower than the national average, at 85%. According to the Idaho Office of Highway Safety, nearly two-thirds of people killed in motor vehicle crashes are not properly restrained. The majority of those killed are on rural roads.

According to NHTSA, the national use rate for seat belts was 90.7% in 2019. NHTSA data for 2017 shows nearly 15,000 people survived crashes because they chose to buckle up.

For more on Idaho's education campaign to remind motorists to buckle up, go to http://shift-idaho.org/buckleupidaho/.

Funding for extra traffic patrols is provided by a grant from the Idaho Transportation Department Office of Highway Safety through the National Highway Traffic Safety Administration.
