ISP partners with ITD and local law enforcement to stop impaired driving June 29th through July 12th

For Immediate Release: 06/29/13 at 2:00 p.m.

MERIDIAN - The Idaho State Police is partnering with the Idaho Transportation Department and local law enforcement agencies statewide to make highways safer with high-visibility impaired driving enforcement patrols from June 29th through July 12th. Using federal grant funds, these agencies are first seeking to educate the public about the dangers of drinking and driving and, then, if the message is not heeded, to make arrests.

"The effort is part of Idaho's Toward Zero Deaths' goal to someday have no traffic deaths on Idaho's roads. Traffic deaths are not just numbers. They are family members and friends lost," said Kevin Bechen, with ITD's Office of Highway Operations and Safety.

During the campaign, officers will be watching for impaired drivers. They also will check for seat belt use. "Avoid driving any vehicle when 'buzzed' or drunk," says Idaho State Police Sgt. Michael Wendler. He explains, "It's not worth the risk. Not only do you risk injuring or killing yourself or someone else, but the financial costs of an arrest or crash are significant."

In 2012, there were 9,686 DUI arrests in Idaho and there were 73 fatalities resulting from impaired driving. In addition, there were 1,454 impaired driving crashes and 39.5% of all fatalities on Idaho's roads in 2012 were the result of impaired driving!

The solution to stop these tragedies is simple.

- Designate a sober driver before drinking and give them your keys.
- If you are impaired, call a taxi, a sober friend or family member to get you home safely.
- If you go to a bar, check with the employees, many bars have programs to give patrons a free ride home.
- If a friend is about to drive impaired, take his or her keys and help make other transportation arrangements.
- Promptly report suspected drunk drivers you see on roadways to law enforcement. Call the Idaho State Police on your cell phone at *ISP (*477) or simply dial 9-1-1.

For all on the roadways, "Your best defense against drunk drivers is to always wear a seat belt and remain attentive to your surroundings and other drivers," Sgt. Wendler said.

  • Criminal investigations
  • Report writing

ISP will actively be recruiting new Troopers with a job announcement to be published on July 1st. Anyone interested in learning more about the Idaho State Police or in applying to be an ISP Trooper should visit the ISP website at www.isp.idaho.gov and add their name to the hiring notification database.

Lewiston Drug Dealer Sentenced to Federal Prison

COEUR D'ALENE – John Gilbert Rincon, 41, of Lewiston, Idaho, was sentenced today in United States District Court in Coeur d’Alene to 61 months in federal prison for conspiracy to distribute methamphetamine. U.S. District Judge Edward J. Lodge also ordered Rincon to serve ten years of supervised release, and to forfeit $20,000 in U.S. currency. He pleaded guilty to the charge on December 4, 2012.

According to court documents, beginning July 2011, and continuing through December 22, 2011, Rincon participated in drug transactions, distributing fifty grams or more of a substance containing methamphetamine. Three members of the conspiracy have pleaded guilty and have been sentenced: Robin L. Spencer, April Lynne Lauby, and Jacob J. Custodio.

The case was investigated by the Clearwater County Sheriff's Office, Orofino Police Department, Idaho State Police, and Federal Bureau of Investigation.

North Idaho Man Enters Felony Plea for Illegally Cutting Timber

COEUR D’ALENE – Norman Leroy Bogart, 54, of Kingston, Idaho, pleaded guilty yesterday in federal court to illegally cutting timber on national forest lands, U.S. Attorney Wendy J. Olson announced. An information charging him with one felony count of willful injury or depredation to property of the United States was filed in United States District Court in Coeur d’Alene on June 17, 2013.

According to the plea agreement, the defendant admitted that between April and October, 2012, he cut and hauled timber illegally from an area within the Idaho Panhandle National Forests, near his home in Kingston, Idaho. The U.S. Forest Service began to investigate after discovering that 40 green trees had been cut within the one area. U.S. Forest Service investigators used a deer camera to capture Bogart’s vehicle traveling to and from the cut location.

On October 3, 2012, the U.S. Forest Service executed a search warrant at Bogart’s residence and seized more than 58 cords of timber cut into firewood. One pile was estimated to be 40 feet long, 10 feet wide and 10 feet tall, according to the plea agreement. Investigators determined that most of the timber was green when cut. Investigators matched some of the larger timber seized from Bogart’s property to several stumps at the cut location within the Idaho Panhandle National Forests.

“We are pleased to see this case prosecuted and want to emphasize that timber theft will not be tolerated on national forest system lands,” said Mary Farnsworth, Idaho Panhandle National Forest Supervisor. “I especially would like to thank our law enforcement officers who invested many hours investigating this case to ensure the public is reimbursed for their losses.”

The charge of willful injury or depredation to property of the United States is punishable by up to ten years in prison, a maximum fine of $250,000, and up to three years of supervised release.

Sentencing is set for September 16, 2013, before U.S. District Judge Edward J. Lodge at the federal courthouse in Coeur d’Alene.

The case was investigated by the U.S. Forest Service, with the assistance of the Idaho State Police, the North Idaho Violent Crimes Task Force, and the Shoshone County Sheriff’s Office.

Bonners Ferry Man Sentenced for Unlawfully Possessing Firearm

COEUR D’ALENE – Donald Paul Hankey, 28, of Bonners Ferry, Idaho, was sentenced yesterday in United States District Court to 18 months in prison for felon in possession of a firearm, U.S. Attorney Wendy J. Olson announced. U.S. District Judge Edward J. Lodge also ordered Hankey to serve three years of supervised release, and pay a fine of $1,500. He pleaded guilty to the charge on March 5, 2013.

According to court documents, on November 13, 2012, Hankey knowingly and illegally possessed a Springfield Armory 9 millimeter handgun. Hankey is prohibited from possessing firearms due to a previous felony conviction for possession of a controlled substance. Hankey will forfeit the firearm he unlawfully possessed.

The case was investigated by the North Idaho Violent Crimes Task Force (NIVCTF). The NIVCTF members include the Federal Bureau of Investigation, the Idaho State Police, Kootenai County Sheriff's Office, Shoshone County Sheriff's Office, Bonner County Sheriff's Office, Coeur d'Alene Police Department, Post Falls Police Department, and the Coeur d'Alene Tribal Police Department. The NIVCTF investigates a myriad of violent crimes, including armed robbery, kidnapping, felonious assault and drug trafficking.

The case was prosecuted as part of Idaho’s Project Safe Neighborhoods Program, which seeks to reduce gun violence in Idaho.

LEWISTON - The Idaho State Police has concluded a three year investigation involving the distribution and sale of illicit drugs in the Lewiston and Clarkston area that has resulted in one arrest and over a hundred thousand dollars worth of drugs out of that community.

One man, age 38, with multiple aliases was arrested and charged with possession and distribution of a controlled substance. After fingerprinting, he was identified as Francisco Munguia Diaz, aka Glen Cadenas, aka "Chico," aka "Theo." During the arrest and subsequent search warrants, law enforcement seized 2 pounds of methamphetamine with a street value of $62,000, 1 pound of cocaine with a street value of $22,000, 6 pounds of marijuana with a street value $18,000, 189 ecstasy pills with a street value of $1,900. Police also seized drug proceeds in the amount of $186,000 in cash and 6 vehicles used in the distribution of the drugs.

"Although this has been a long investigation and a lot of man hours, the arrest and seizure came together at the end with the help of multiple law enforcement agencies," said ISP Detective Bryce Scrimsher. The U.S. Drug Enforcement Agency and the Bureau of Indian Affairs were long-term partners in the investigation and the Lewiston Police Department, Nez Perce Tribal Police and the Quad City Drug Task Force assisted with search warrants and the arrest.

The case against Diaz is currently being prosecuted in U.S. District Court for the Eastern District of Washington.

ITD, ISP, and law enforcement agencies across the Magic and Wood River Valley partnered to boost seatbelt usage

JEROME - As motorists took to the roads this Memorial Day holiday, the Idaho Transportation Department, the Idaho State Police and partnering Magic and Wood River Valley law enforcement urged everyone to buckle up. Between May 20th and June 2nd law enforcement officers were out in full force, taking part in the 2013 Click It Don't Risk It seat belt enforcement mobilization and cracking down on motorists who were not belted.

During this year's mobilization, ISP Troopers in the Magic and Wood River Valley made more than 800 contacts with the motoring public, usually through traffic stops. During these contacts Troopers wrote 80 seatbelt citations when occupants were observed not wearing their seatbelts. Also, Troopers arrested three impaired drivers, made seven felony arrests, and apprehended two fugitives. They also made arrests or issued citations for 13 drug related offenses.

"As we kick-off the busy summer driving season it's important that everyone buckles up every time they go out, both day and night - no excuses," said Sgt. Michael Wendler, "Our officers are prepared to ticket anyone they come in contact with who is not wearing their seat belt - Click It Don't Risk It."

According to the U.S. Department of Transportation's National Highway Traffic Safety Administration (NHTSA), 52 percent of the 21,253 passenger vehicle occupants killed in 2011 were not wearing their seat belts at the time of the crash. As noted, deaths involving seat belt nonuse are more prevalent at night than during the daytime. According to NHTSA, 62 percent of the 10,135 passenger vehicle occupants killed in 2011 during the overnight hours of 6 p.m. to 6 a.m. were not wearing their seat belts at the time of the crash.

Tragically, lack of seatbelt use contributes to many lives lost every year right here in Idaho. In, 2011 there were 123 occupants of motor vehicles killed in crashes in Idaho. Of those killed, a mere 39 were restrained, leaving 84 who were not. Based upon the fact that studies have shown approximately 80% of Idahoans regularly wear their seatbelt, you are almost ten times as likely to die in a crash if you are not restrained.

"Seat belts save thousands of lives every year, but far too many motorists are still not buckling up, especially at night when the risk of getting in a crash is even greater," said Sgt. Wendler, "We want everyone to have a safe summer, but it requires an important step on the part of motorists - clicking that seat belt."

For more on the Click It Don't Risk It mobilization, please visit www.nhtsa.gov. For interviews, ride-alongs, or other media inquiries please contact your local law enforcement or the District 4 Idaho State Police at 208-736-3060.

Payette Man Sentenced for Possessing Firearms in Furtherance of Drug Trafficking

BOISE – Chadwick Duane Powell, 35, of Payette Idaho, was sentenced today in United States District Court to 75 months in prison followed by five years of supervised release for possession of firearms in furtherance of drug trafficking crimes, U.S. Attorney Wendy J. Olson announced. U.S. District Judge Edward J. Lodge also ordered Powell to forfeit two firearms and the ammunition he possessed, and to pay $2,670.42 in restitution for the cleanup of hazardous materials related to a methamphetamine laboratory that Powell kept in a shed behind his residence. On March 12, 2013, Powell pleaded guilty to count three of the superseding indictment.

According to the plea agreement, on June 11, 2012, law enforcement officers executed a search warrant at a residence in Fruitland, Idaho. Powell was located hiding in a closet in the master bedroom. After retrieving a key from Powell, the officers unlocked a shed behind the residence that housed a small methamphetamine laboratory. The building contained chemicals, ingredients and equipment necessary to manufacture and produce methamphetamine. In Powell’s bedroom, law enforcement located a glass jar containing 41.1 grams of pseudoephedrine. In the shed, officers found a modified Winchester 12 gauge shotgun with a sawed-off barrel and six shotgun shells. According to the plea agreement, Powell admitted he possessed the shotgun in furtherance of drug trafficking crimes, including manufacturing methamphetamine and maintaining premises for the purpose of manufacturing methamphetamine. Officers also discovered a loaded FEG 9mm handgun with a single round of 9 millimeter ammunition in Powell’s bedroom. A box of 9 millimeter ammunition containing 29 rounds was located in the garage next to the shed which housed the methamphetamine laboratory.

The case was investigated by Idaho State Police, Fruitland Police Department, and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
