Idaho State Police Champions Responsible Practices in the Mobile Bar Industry

MERIDIAN, Idaho - The rising popularity of mobile bars is revolutionizing the hospitality industry, introducing dynamic options for social gatherings, events, and celebrations. While these mobile bars add flair to community events, they also pose unique challenges for law enforcement and local regulatory bodies, demanding the right balance of oversight and public safety.

In the traditional landscape, alcohol sales and consumption operate under a licensed brick-and-mortar establishment, with exceptions for licensees to obtain catering permits for special events that are obtained through the city or county where the event is to be held. Mobile beer and wine bars recently emerged as innovative offsite solutions but come with specific regulations. As each alcohol license is separate and distinct and cannot be transferred, shared, or lent, only the brick-and-mortar store, with current employees operating it, may operate a mobile bar. It is a felony to operate a mobile bar and sell liquor without an appropriate license.

A recent operation spearheaded by the Idaho State Police Alcohol Beverage Control Bureau (ABC) in November spotlighted the imperative need to comply with these regulations. A female mobile bar owner was arrested on felony charges for persisting to operate at a public event without obtaining a license or alcohol catering permit. She attempted to get a permit but was denied because she had no legal affiliation with the liquor licensee. The female still attended the event and was selling alcohol when she was arrested. The incident underscores the need to know and follow regulatory guidelines for public safety purposes.

Alcohol-related laws play a pivotal role in creating safe communities by mitigating risks associated with the sale and consumption of alcohol. Preventing over-service is paramount in reducing alcohol-related incidents, and the lack of oversight can create a dangerous environment.

Captain Rocky Gripton, Bureau Chief of the Idaho State Police Alcohol Beverage Control bureau, emphasizes law enforcement's primary goal of ensuring community safety. When mobile bars operate within legal boundaries, they enhance the social landscape without inhibiting celebrations. Gripton underscores that responsible adherence to regulations, including insurance mandates and service practices, contributes to the community's success without compromising public safety. Collaboration within the legal framework is crucial to establishing an environment where everyone can celebrate responsibly.

In an ongoing commitment to public safety, the Idaho State Police urges mobile bar operators to prioritize legal compliance. To further this initiative, ABC plans to host a series of classes in early spring to raise awareness of liquor laws for mobile bars. As this complex topic involves many technicalities, ABC detectives urge anyone with questions to call their office at 208-884-7060 to seek clarification about specific concerns. Several questions have involved misconceptions about the basic legalities of operating mobile bars by the general business community.

2023 WINTER HOLIDAY SEASON DRIVE SOBER OR GET PULLED OVER
ENFORCEMENT CAMPAIGN
SAMPLE NEWS RELEASE

FOR IMMEDIATE RELEASE: 12/15/23
CONTACT: Corporal Cory Juber- Idaho State Police District 2

The Idaho State Police joins statewide effort to stop impaired drivers from ruining the holidays.

Lewiston, Idaho - This winter holiday season the Idaho State Police is joining the Idaho Office of Highway Safety (OHS) and more than 50 law enforcement agencies across Idaho to urge drivers to think twice before drinking and driving. Now through New Year's Day, drivers will see officers working on a special high-visibility enforcement campaign to spread the message about the dangers of impaired driving.

Law enforcement will be on heightened watch for drivers under the influence and remind everyone, "Drive Sober or Get Pulled Over." Always make a plan before heading out to a holiday celebration and have a sober ride home.

According to data from OHS, last year in Idaho there were 1,818 impaired driving crashes killing 110 people. Tragically, impaired driving puts Idahoans at risk every day and it is completely preventable.

"Drivers have a choice to make: Follow the law and respect your community members by refraining from drunk driving. Or make the choice to drive drunk, put your own life at risk, and endanger the lives of innocent people who share the road with you," said Corporal Cory Juber, of the Idaho State Police "We need a commitment from everyone to keep the roads free of drunk drivers so our friends, family, and neighbors can have a safe holiday," he said.

Idaho State Police Domestic Highway Enforcement Team Makes Significant Seizure in the Fight Against Illegal Substances

MERIDIAN, Idaho - The Idaho State Police (ISP) Domestic Highway Enforcement Team (DHE) successfully intercepted and seized illegal substances during a traffic stop, underscoring law enforcement's crucial role in safeguarding our communities.

On December 12th, DHE troopers conducted a traffic stop near Idaho Falls. Suspicious behavior was observed during the stop, and a thorough vehicle search was conducted. The results were the discovery and seizure of significant amounts of illegal drugs and drug paraphernalia:

- Methamphetamine - 2.7 pounds
- Cocaine - 2.7 pounds
- Fentanyl - over 5,300 pills
- Drug paraphernalia

During the incident, DHE was assisted by the Idaho Falls Police Department and their K9 unit.

Over the past several weeks, DHE also made seizures throughout Idaho. In the Coeur d'Alene area, the team seized almost a pound and a half of methamphetamine, over 400 fentanyl pills and two guns near Pocatello, nearly 4,800 fentanyl pills in the Coeur d'Alene area, which expanded into an investigation in Montana, and almost a pound of methamphetamine leaving the Treasure Valley towards Twin Falls.

Law enforcement professionals' effective responses during encounters showcase the importance of patrols and traffic stops to identify and disrupt criminal activities. Through proactive measures, partnerships, and high-visibility patrols, ISP continues working to keep the public safe.

The DHE Team is a multi-jurisdictional narcotics task force that identifies, disrupts, and dismantles local, multi-state, and international drug trafficking organizations using an intelligence-driven, multi-agency, prosecutor-supported approach. The Team is supported by the Oregon-Idaho High-Intensity Drug Trafficking Area (HIDTA) program, also composed of members from the Idaho State Police, which is an Office of National Drug Control Policy (ONDCP) sponsored counterdrug grant program that coordinates with and provides funding resources to multi-agency drug enforcement initiatives.

As ISP continues to prioritize the people of Idaho's safety and security, we remain dedicated to combatting illegal drug trade and removing illicit activity from our streets.

Joint Press Release from Idaho State Police and Idaho Transportation Department: Statewide Effort to Stop Impaired Drivers from Ruining the Holidays

MERIDIAN, Idaho - As the holiday season approaches with joyous celebrations, the unfortunate reality for some across Idaho is that these festivities are abruptly cut short by the devastating impact of impaired driving.

From December 13 through New Year's Day, over 50 Idaho law enforcement agencies will collaboratively engage in a national effort to remove impaired drivers from our roadways. Officers will actively patrol to safeguard the holidays, preventing impaired drivers from ruining the holidays for their own safety and that of others.

Colonel Kedrick Wills, Director of the Idaho State Police (ISP), emphasized the collective commitment to public safety, stating, "Embodying an unwavering dedication to public safety, law enforcement agencies across the region stand united in the collective responsibility of preventing impaired driving and saving lives. Our collaborative enforcement efforts serve as a potent deterrent, leaving no room for doubt that impaired driving is unacceptable. Make the right choice for the well-being of others - never drive impaired."

To coincide with the launch of the statewide impaired driving enforcement campaign, a one-day regional summit on impaired driving took place at the Boise Centre. The summit featured distinguished speakers from Mothers Against Drunk Driving (MADD), the National Highway Traffic Safety Administration (NHTSA), and law enforcement experts from agencies throughout the state and the nation.

"Data reveals a concerning 14.2% increase in alcohol-related crash fatalities nationwide from 2020 to 2021, underscoring the critical importance of responsible driving behaviors," explained Greg Fredericksen, NHTSA's Region 10 Administrator. "NHTSA joins Idaho's state agencies and local partners to launch a vital initiative featuring impactful public service messages like 'Drive Sober or Get Pulled Over,' emphasizing the urgent need to address the alarming surge in impaired driving incidents."

According to data from the Idaho Office of Highway Safety (OHS), last year in Idaho there were 1,818 impaired driving crashes, and 110 people were killed.

"Driving under the influence is not an accident or a mistake. It is a choice and a crime," said Dennis Maughan, MADD Regional Executive Director. "It not only puts the driver's life at risk, but also endangers the lives of innocent pedestrians, passengers, and other drivers who share the road with them."

OHS and law enforcement encourage anyone celebrating this holiday season to include a plan for a sober ride home and to never drive impaired. Making a plan before drinking makes it easier to stick to, once intoxicated.
