IDAHO STATE POLICE NEWS RELEASE

For Immediate Release: 04/19/21 02:40 p.m.
Please direct questions to the ISP Public Affairs Office isppio@isp.idaho.gov or your local District.

April is Distracted Driving Awareness Month.

The Idaho State Police are joining dozens of other Idaho law enforcement agencies in a statewide effort to remind Idahoans of the dangers of distracted driving.

Beginning today and continuing through April 30, extra ISP patrols will be on the road in an effort to educate motorists and enforce Idaho's distracted driving laws, particularly Idaho's law that prohibits driving while using a cell phone.

"Any activity that takes your attention away from the road is defined as distracted driving, and it only takes a moment or two for a distraction to cause a serious injury crash," said Lt. Chris Weadick of the Idaho State Police. "Whatever the temptation, the distraction just isn't worth taking your eyes or your mind away from driving."

Idaho's new distracted driving law went into effect July 1, 2020, and allowed citations for violators beginning January 1, 2021. The law forbids drivers from using a cell phone or other electronic device at any time while their vehicle is in operation, even when stopped at a red light.

3 Types of Distractions: Using a cell phone while driving includes all three types of dangerous distractions:

- Visual - taking your eyes off the road.
- Manual - taking your hands off the wheel.
- Cognitive - taking your mind off what you're doing.

Here are some of the tips that law enforcement will be sharing with drivers they pull over for driving distracted:

- If you need to use your phone's GPS, enter the address in before you start driving.
- Look into Bluetooth options for your car so you can talk hands-free.
- If you have to read or send a text, pull over and park the car.
- Idaho's hands-free law applies to drivers stopped at traffic lights and stop signs.
- Leave the distractions behind, stay focused on the road, and drive engaged so you can help save lives.

"We see folks with their dogs jumping on them, searching for napkins to clean up a spilled soda, and even people watching videos while driving. These drivers not only endanger themselves but their passengers and everyone on the road. And we see the results when those tragic crashes happen. That's why Troopers feel so strongly that reminding Idahoans to drive engaged and avoid distractions is important," said Lt. Weadick.

The Idaho Transportation Department's Office of Highway Safety has a campaign calls "Shift Idaho", helping Idahoans reduce distracted driving by encouraging conversations and education about engaged driving. Find more resources at https://shift-idaho.org/.

-----------------------------

Additional distracted driving patrols are funded by a grant from the Idaho Transportation Department's Office of Highway Safety through the National Highway Traffic Safety Administration. Thank you to these agencies for supporting ISP's efforts to keep Idaho's roadways safe.

IDAHO STATE POLICE NEWS RELEASE

Please direct questions to the ISP Public Affairs Office isppio@isp.odaho.gov

The following is a release issued from the office of the Acting United States Attorney Rafael M. Gonzalez Jr., District of Idaho. Detectives from the Idaho State Police played a major role in this 2019 investigation that involved numerous federal and state charges.
The initial release is also attached.
ISP wants to thank the U.S. Attorney's Office and all the partners who participated in this investigation intended to keep children safe from online predators.

Federal Jury Convicts Boise Man of Attempted Coercion and Enticement of a Minor

BOISE - After a three day jury trial, a federal jury sitting in Boise found Jordan Michael Drake, 33 of Boise, guilty of attempted coercion and enticement of a minor, and attempted use of interstate facilities to transmit information about a minor, Acting U.S. Attorney Rafael M.Gonzalez, Jr. announced today. Chief U.S. District Judge David C. Nye presided over the trial, which began on April 5th, and concluded with the guilty verdicts on April 8th.

According to testimony and evidence presented at trial, Drake communicated online with an undercover detective posing as a 15-year-old girl. During the communications, Drake attempted to persuade, induce, and entice the minor into engaging in sexual activity with him and requested the minor's address so that he could meet with the minor for sexual activity. Drake traveled to an address where he believed the minor resided, where law enforcement officers arrested him.

"Online predators who attempt to entice minors take advantage of our most precious resource, our children," said Acting U.S. Attorney Gonzalez. "We are committed to prosecuting dangerous offenders who troll the internet looking to sexually exploit children, and we will continue to work together with our partners to identify these predators and their victims."

The charge of attempted coercion and enticement of a minor carries a minimum of ten years and up to life in federal prison, a fine of up to $250,000, and at least five years and up to lifetime of supervised release. The charge of attempted use of interstate facilities to transmit information about a minor carries a term of up to five years of federal prison, a fine of up to $250,000, and at least five years and up to lifetime of supervised release. Drake will be required
to register as a sex offender as a result of the conviction.

Sentencing is set for July 27, 2021, before Judge Nye at the federal courthouse in Boise.

The investigation was part of "Operation Butterball," a joint state and federal undercover operation conducted in Ada County in November 2019 to identify individuals predisposed to meet minors for sexual contact. Participating agencies included Homeland Security Investigations (HSI), Idaho Internet Crimes Against Children Task Force, Idaho Attorney General's Office, Idaho State Police, Meridian Police Department, United States Postal Inspection Service, ICE Enforcement and Removal Operations (ERO), Rupert Police Department, Jerome County Sheriff's Office, Ada County Prosecutor's Office, and the United States Attorney's Office.

"The collaboration between ICAC and our federal law enforcement partners continues to yield results that help protect Idaho children from online predators," Idaho Attorney General Lawrence Wasden said. "This conviction and the previous sentences stemming from this operation highlight the partnerships in place between local, state and federal law enforcement agencies that continue to put dangerous individuals in prison and keep them away from our young people."

Drake is among five defendants arrested and charged in federal court as a result of Operation Butterball. Previously, the following defendants were sentenced in federal court:

- Christopher Niday, 54, of Summerville, Oregon, was sentenced on October 20, 2020, by Chief Judge Nye to four years in federal prison, followed by ten years of supervised release, for travel with the intent to engage in illicit sexual conduct.

- Jesse Kelly-Castillo, 24, of Boise was sentenced on December 9, 2020, by Chief Judge Nye to ten years in federal prison, followed by 15 years of supervised release, for attempted coercion and enticement of a minor.

- Maxwell Hennerley, 24, formerly of Boise, was sentenced on January 7, 2021, by U.S. District Judge B. Lynn Winmill to five years in federal prison, followed by five years of supervised release, for attempted use of interstate facilities to transmit information about a minor.

- Vern Leeroy Moore, 56, of Kuna, was sentenced on April 7, 2021, by Chief Judge Nye to five years in federal prison, followed by five years of supervised release, for attempted use of interstate facilities to transmit information about a minor.

These cases were brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. As part of Project Safe Childhood, the U.S. Attorney's Office for the District of Idaho and the Idaho Attorney General's Office partner to marshal federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. A collision Friday evening, April 2 on Interstate 84 involving an ISP Trooper and a semi is under investigation by the Jerome County Sheriff's Office. The incident occurred as the Trooper was driving with his emergency lights on his way to a call of a separate, unrelated incident a short distance away. No one was injured in the collision.

The collision occurred at 6:45 pm in the eastbound lane of travel on I-84 at milepost 170.7 just east of Jerome. Travel is reduced to one lane in both directions in the area due to ongoing road work. As a result, traffic was blocked for approximately one hour eastbound. Westbound traffic was also slowed and directed around the incident using the shoulder.

As a precaution, the Trooper was taken to a nearby hospital for observation and was released later that evening. The semi driver did not require medical assistance.

The incident the trooper was responding to was a single-vehicle incident that sadly did result in the death of a man from Jerome. That incident remains under investigation by the Idaho State Police. More on that incident can be found at https://idahostatepolice.blogspot.com/2021/04/fatal-crash-east-of-jerome.html.
