As another Legislative season is nearly upon us, ISP is sharing a letter with information useful for those planning to participate in the legislative process that may include a visit to the Idaho State Capitol.

During these extraordinary times, the letter is a reminder for those wishing to participate in the legislative process that rules of decorum at the State Capitol are intended to maintain public order and ensure a balance between public participation and public health and safety.

Rules of decorum are set by the Idaho Legislature. The Legislature convenes on January 11, 2021. Annual rules are expected to be adopted at that time, and Idahoans are encouraged to follow the links provided in the letter to stay updated as conditions may change.

The Idaho State Police are authorized to assist in maintaining the public order that allows elected leaders and the public to safely conduct the business essential to keeping Idaho a state of healthy families and strong, vibrant communities.

As Idahoans prepare to welcome a new year, Troopers with the Idaho State Police remind motorists extra patrols remain out in force through this weekend with the goal of increasing safety by reducing DUI-related crashes.

Winter weather is also in the forecast for much of Idaho, making engaged driving essential.

"We want families to stay whole and healthy and have a new year to look forward to. Driving sober, driving engaged, and driving for conditions is the best way to keep our roads safe for travel," said ISP Lt. Chris Schenck.

ISP is joining partner law enforcement agencies throughout the state and the ITD Office of Highway Safety in supporting the effort to remove DUI drivers from Idaho roadways and keep families whole during this holiday season.

Approximately one-third of all traffic crash fatalities in the US involve drunk drivers, according to the National Highway Traffic Safety Administration NHTSA.

What can you do to prevent impaired driving?

- Plan your safe ride home before you start the party;
- Choose a non-drinking friend as a designated driver;
- Arrange for a ride share service or taxi.
- If you're hosting a party where alcohol will be served, serve non-alcoholic beverage options and make sure all guests leave with a sober driver;
- Always wear your seat belt - it's your best defense against impaired drivers, and;
- If you see what could be an impaired driver on the road, call *477 (*ISP) or call 911. Your actions could save a life.

To be prepared for changing winter road conditions:

- Check 511.idaho.gov/ before you travel;
- Follow local forecasts from weather.gov/ or local media;

Extra DUI patrols run through January 3, 2021. Beginning Friday, January 1, 2021, drivers reported in violation of Idaho's "hands-free" device code risk receiving a citation.

Since July, Idaho State Troopers' efforts to educate motorists about the dangers of distracted driving and the state's new "hands-free" device law has resulted in more than 700 warnings issued.

"There is nothing on your screen that is worth your life or the life of another," said ISP Lt. Chris Weadick. "ISP and our local law enforcement agencies are committed to keeping Idaho roads safe. The goal is to change driving behavior and save lives, and we urge all drivers to pay attention when they are behind the wheel."

Sad Stats:

According to the Idaho Transportation Office of Highway Safety:

- 241 people were killed in Idaho in crashes attributed to distracted driving between 2014 and 2018.
- In 1 in 5 crashes in Idaho, distracted driving is a contributing factor.

Idaho's "hands-free" device law went into effect July 1, 2020, allowing officers a six-month period to issue warnings when they found evidence of violations. Troopers say they have seen more drivers using Bluetooth and other hands-free device options, but more education is needed.

"If you're texting or using a device, you're not driving," said ISP Sgt. Curt Sproat. "For a lot of people, devices have become a habit, but it's a very dangerous habit when we're driving. That's why the law is in place and if a citation is the incentive some drivers need to put the device down and focus on the road, officers now have that option."

What Drivers Need to Know about Idaho's Hands-Free Device law, ISC 49-1401A:

- Idaho's hands-free device law requires electronic devices to be in hands-free mode while driving, including when stopped at a red light or stop sign. In other words, with few exceptions, the new hands-free law makes holding a cell phone illegal while operating a vehicle;
- Drivers can only use electronic devices and mobile phones in hands-free mode;
- Drivers are only permitted to touch devices to activate hands-free mode;
- Drivers are not permitted to hold or support any electronic device/phone;
- Activation of GPS, voice to text, and making or receiving calls is permitted with one-touch or voice command;
- Handheld use is allowed only if the vehicle is both stationary and not located in a public travel lane, or an emergency;
- Drivers are not allowed to touch a device for texting, emailing, apps, video, or internet use;
- Should a driver receive two distracted driving violations in three years, the new law states insurance companies can consider those violations when establishing insurance rates for a driver.

What Drivers Can Do:

- If you are expecting a text message or need to send one, pull over and park your car in a safe location. Once you are safely off the road and parked, it is safe to text;
- Designate your passenger as your "designated texter." Allow them access to your phone to respond to calls or messages;
- Activate your phone's "Do Not Disturb" feature, or put your cell phone in the trunk, glove box, or back seat of your vehicle until you arrive at your destination if you are struggling not to use your device while driving.

Penalty for Violating the Hands-Free Law:

1st offense - $75 fine, with court costs = $131.50.
2nd offense within three years - $150 fine, with court costs = $206.50.  
3rd and subsequent offenses within three years - $300 fine, with court costs = $356.50. 
Three offenses in three years can also lead to a license suspension of up to 90 days.

On Monday, December 28th 2020 about 11:11 AM, the Idaho State Police received a report of a fatal one-vehicle crash on US95 south of Naples, Idaho. A blue 2014 Nissan Versa driven by Bryan Krichbaum, 35 year old of Moyie Springs, ID, was traveling south on US95 and went well off the road, crashing into trees. The crash occurred sometime December 24th or 25th but wasn't visible from the roadway, and snow had covered the crash location. Seat belts were worn, and airbags deployed. Next of kin have been advised. The investigation continues.

On December 24th, 2020 at approximately 7:36 pm the Idaho State Police investigated a crash northbound on US95 at the intersection of Eid Road, south of Moscow. Stacey Davis, 47 years old of Moscow, was travelling southbound on US95 approaching Eid Road in a red 2005 Pontiac Vibe. Hailey Dismukes, 24 years old of Post Falls, was travelling northbound on US95 approaching Eid Road in a blue 2000 Nissan Altima. Davis attempted to turn left on to Eid Road as Dismukes approached, and the cars collided head on. Davis was transported to Gritman Medical Center in a personal vehicle. Dismukes and her passengers, Brock Montee, 32 years old of Post Falls, and Calleen White, 75 years old of Coeur d'Alene, were transported to Gritman Medical Center via ambulance. White was pronounced deceased at Gritman Medical Center. Next of kin has been notified. Investigators are still looking in to which occupants were wearing seatbelts. The investigation is ongoing.

On Wednesday, December 23, 2020, at approximately 5:03 AM, Idaho State Police investigated a two-vehicle fatality crash northbound US91 near Stock Trail Road, North of Forth Hall.

John F. Hamann, 39, of Pocatello, was driving southbound in a 1992 Dodge. Tena A. Silveira, 60, of Pocatello, was driving northbound in a 2004 Chevrolet Classic.

Hamann crossed over into the northbound lane of traffic where his vehicle struck the Chevrolet head on. Both drivers succumbed to their injuries at the scene. The lanes of US91 were blocked for approximately 3 hours. Hamann's and Silveira's next of kin have been notified.

This crash is under investigation by the Idaho State Police.

On Tuesday, December 22, 2020, at approximately 10:30 a.m., the Idaho State Police investigated a fatal, two vehicle collision, southbound US95 near milepost 195. This is near Riggins in Idaho County.

Jeffrey Barks, 43, of Saint Clair, Michigan, was traveling northbound on US95 in a Ford pulling a 15 foot trailer. Jonathan Hunter, 33, of Middleton, was traveling southbound on US95 in a semi-truck. The Ford vehicle crossed the left of center and the two vehicles collided.

Barks was transported to St. Lukes McCall Medical Center and was pronounced deceased after arrival. Next of kin has been notified. Hunter was transported to Syringa General Hospital in Grangeville.

Both drivers were wearing seatbelts. The lanes were blocked for approximately six hours.

This investigation is ongoing.

On Tuesday, December 22, 2020, at approximately 8:46 a.m., Idaho State Police investigated a two-vehicle, fatality crash eastbound I84 at milepost 71, 14 miles east of Boise.

John Wheeler, 67, of Boise, was westbound on I84 at milepost 71 in a 2007 Mazda B2300 pickup. Christian Giesbrecht, 44, of Pocatello, was eastbound on I84 in a 2021 Peterbilt semi pulling a trailer.
The Mazda crossed into the eastbound lanes, where it collided with the Peterbilt. The Mazda came to rest in the median. The Peterbilt came to rest on the eastbound I84 71 off-ramp.

Giesbrecht and Wheeler were wearing seatbelts. Wheeler succumbed to his injuries at the scene of the crash. His next of kin has been notified.

The left lane was blocked by emergency vehicles for approximately one hour and forty five minutes.

The crash is under investigation by the Idaho State Police.

On Monday, December 21, 2020 at approximately 9:37 a.m. Idaho State Police responded to a fatality crash on SB US95, milepost 532.2, south of Eastport, Idaho. A black 2007 Saturn Vue driven by Shannon D. Taylor, 34, of Bonners Ferry was traveling southbound when the vehicle left the roadway, traveling approximately 174 feet off the roadway and came to rest fully submerged on its top in the river. The passenger, Alicia P. Taylor, 56, of Bonners Ferry was transported by ground ambulance to Boundary Community Hospital, where she was then transported by air ambulance to Kootenai Health. Shannon Taylor was pronounced deceased at the scene. Seatbelts were worn by both occupants. Next of kin have been notified, the investigation is ongoing.

On Friday, December 18, 2020, at 1:52 p.m., Idaho State Police investigated a fatality crash near the intersection of Lansing Ln. and Purple Sage Rd. in Middleton.

A 2003 Toyota Camry being driven by a 21 year old male, was traveling northbound on Lansing Ln. and came to a stop at the intersection of Purple Sage Rd. The Vehicle then proceeded northbound, failing to yield to eastbound traffic. The Camry was struck by a 2016 Ram pickup being driven by a 68 year old female.

The male driver of the Camry succumbed to his injuries on scene. His passenger, a juvenile, was transported by air ambulance to Saint Alphonsus Regional Medical Center in Boise, where he succumbed to his injuries. The Female driver of the Ram was not transported.

This crash is under investigation by the Idaho State Police.

On December 18th, at approximately 6:10 am, Idaho State Police investigated a two vehicle fatality crash on US95 near milepost 417, just south of Coeur d?Alene.
Jeremy Shuman, 30, of Post Falls, ID, was Northbound on US95 in a Red 1983 Chevrolet pickup, when the pickup left the roadway. The pickup travelled into the median and rolled and Shuman was ejected. The Chevrolet pickup continued into the Southbound lanes where it came to rest. Jason Thompson, 45, of Saint Maries, ID, was Southbound on US95 in a 1987 Peterbilt log truck when he struck Shuman?s pickup. Lifesaving measures were performed at the scene. Thompson was wearing his seatbelt and uninjured. Next of kin has been notified.

On Thursday, December 17, 2020, at approximately 8:12 a.m., Idaho State Police investigated a three-vehicle, fatality crash northbound US89 at milepost 14, one mile south of Paris.
Preston Schei, 20, of Montpelier, was southbound on US89 at milepost 14 in a 1996 Dodge Ram. Eldon Bird, 63, of Montpelier, was also southbound in a 2011 Chevrolet Silverado. Traeden McPherson, 18, of Paris, was northbound on US89 in a 1998 Honda Accord.

The Dodge went into the northbound lanes to pass the Chevrolet and it collided with the front of the Honda. The Honda came to rest blocking the roadway. The Dodge came to rest on the driver's side, down an embankment on the west side of the roadway. The Chevrolet was struck by debris from the collision. The occupants of the Honda and Dodge were not wearing seatbelts.

McPherson was transported by ground ambulance to Bear Lake Memorial where he succumbed to his injuries. Schei, as well as a juvenile passenger in the Honda, were transported by ground ambulance to Bear Lake Memorial Hospital in Montpelier. Bird went to the same hospital by personal vehicle. Schei was later transported to the University of Utah Medical Center in Salt Lake City, UT by ground ambulance.

The road was completely blocked for approximately three hours. Next of kin has been notified.

The crash is under investigation by the Idaho State Police.

Eastern Idaho Methamphetamine Dealer Sentenced to Over 17 Years in Federal Prison


POCATELLO - Richard A. Burns, 37, of St. Anthony, Idaho, was sentenced in U.S.
District Court to 210 months in federal prison for possession with intent to distribute
methamphetamine, U.S. Attorney Bart M. Davis announced today. U.S. District Judge B. Lynn
Winmill also ordered Burns to serve five years of supervised release following his prison
sentence. Burns pleaded guilty to the charge on December 4, 2019.

According to court records, on May 11, 2019, an Idaho State Police trooper stopped
Burns and a co-defendant on the interstate in Pocatello. While the trooper spoke with the codefendant,
Burns' got into the driver's seat and fled, taking police on a high-speed chase.
Ultimately, Burns crashed the car in Blackfoot and escaped on foot. Officers searched the vehicle
and found over three pounds of methamphetamine located in a bag under the front passenger
floorboard. Additionally, officers found two loaded 9mm handguns in the car.

Officers later apprehended Burns on June 5, 2019, after Idaho State Police detectives
located him traveling to Boise. Officers spiked Burns' vehicle near Carey, Idaho. After searching
Burns' car, officers found almost a pound of methamphetamine; along with digital scales, clean
plastic baggies, a drug ledger, and a 9mm pistol. Burns later confessed to dealing drugs
throughout Idaho.

This case was investigated by the Idaho State Police, Drug Enforcement Administration,
Bannock County Sheriff's Office, Blackfoot Police Department, Bingham County Sheriff's
Office, Bonneville County Sherriff's Office, and Idaho Falls Police Department.

On Thursday, December 17, 2020, at approximately 8:12 a.m., Idaho State Police investigated a three-vehicle, fatality crash northbound US89 at milepost 14, one mile south of Paris.
Preston Schei, 20, of Montpelier, was southbound on US89 at milepost 14 in a 1996 Dodge Ram. Eldon Bird, 63, of Montpelier, was also southbound in a 2011 Chevrolet Silverado. Traeden McPherson, 18, of Paris, was northbound on US89 in a 1998 Honda Accord.

The Dodge went into the northbound lanes to pass the Chevrolet and it collided with the front of the Honda. The Honda came to rest blocking the roadway. The Dodge came to rest on the driver?s side, down an embankment on the west side of the roadway. The Chevrolet was struck by debris from the collision. The occupants of the Honda and Dodge were not wearing seatbelts.

McPherson was transported by ground ambulance to Bear Lake Memorial where he succumbed to his injuries. Schei, as well as a juvenile passenger in the Honda, were transported by ground ambulance to Bear Lake Memorial Hospital in Montpelier. Bird went to the same hospital by personal vehicle. Schei was later transported to the University of Utah Medical Center in Salt Lake City, UT by ground ambulance.

The road was completely blocked for approximately three hours. Next of kin has been notified.

The crash is under investigation by the Idaho State Police.

Troopers with the Idaho State Police are joining their partner law enforcement agencies throughout the state and the ITD Office of Highway Safety in supporting the effort to remove DUI drivers from Idaho roadways and keep families whole during this holiday season.

"We're reminding people if their holiday plans include alcohol, to plan ahead for a safe ride home," said Idaho State Police Trooper Tauna Davis.

"Impaired driving ends lives, changes lives, and leaves families broken. That's something we see first-hand as Troopers. That's why we work to stop impaired driving every day, and this holiday season, we're working overtime so more families can enjoy their holidays together." said Trooper Davis.

The goal of the extra patrols is to increase safety on Idaho's roadways by reducing the number of DUI related crashes.

The deadly impact of driving impaired:

- In Idaho in 2019, DUI fatalities increased by nearly 27%, according to the ITD Office of Highway Safety;
- Approximately one-third of all traffic crash fatalities in the US involve drunk drivers, according to the National Highway Traffic Safety Administration (NHTSA);
- In 2018, 10,511 people were killed in DUI crashes; that's one person every 50 minutes, according to NHTSA.

"There's a grieving family behind every impaired driving crash statistic. As Troopers, we see that grief when we interact with those families, and it's grief they'll experience for the rest of their lives. So, our message is simple; don't drive impaired on either drugs or alcohol, and don't let friends and family drive impaired," said Trooper Davis.

What can you do?
- Plan your safe ride home before you start the party;
- Choose a non-drinking friend as a designated driver;
- Arrange for a ride share service or taxi.
- If you're hosting a party where alcohol will be served, serve non-alcoholic beverage options and make sure all guests leave with a sober driver;
- Always wear your seat belt - it's your best defense against impaired drivers, and;
- If you see what could be an impaired driver on the road, call *477(*ISP) or call 911. Your actions could save a life.

Extra DUI patrols run through January 3, 2021. Funding for extra traffic patrols is provided by a grant from the Idaho Transportation Department Office of Highway Safety through the National Highway Traffic Safety Administration. On Wednesday, December 16, 2020, at approximately 3:34 P.M., Idaho State Police investigated a property damage crash on SB I15 at the 113 on-ramp in Idaho Falls.

Casey Ross, 36, of Idaho Falls was driving southbound entering I15 via the 113 on-ramp in a 2017 Freightliner pulling two trailers. One of the trailers overturned blocking traffic.

The southbound on-ramp is still blocked and crews are on scene working to open the roadway.

Scam Alert

The Idaho State Police have been made aware of another round of telephone scams targeting Idahoans. The recent reports include somewhat new twists on long-familiar scams, however, scammers continue to look for specific circumstances or unique vulnerabilities that make their deceptions especially cruel and unfortunately, sometimes successful. As these scammers can target anyone and can be anywhere in the world, education is the best defense.

In cooperation with local law enforcement agencies and the Idaho Attorney General's Office, ISP is issuing the following alert.


Targeting Registered Sex Offenders

Local law enforcement agencies are receiving reports of offenders being contacted by someone purporting to be from a sheriff's office. Some calls reportedly also include mention of the Idaho State Police. The scammer tells the recipient of the call that they are out of compliance but can pay a bond - usually with gift cards - to stay out of jail. Several of those contacted report losing money to the scam.

Remember: any caller threatening you with jail time or another penalty, and wanting payment via gift cards, prepaid debit cards, money transfer apps, etc. is a scammer. Hang up on them immediately.


Caller ID reads "ID State Police"

A Treasure Valley man recently reported to ISP that his wife answered a call when the caller ID read "ID State Police". The woman was out of state at the time caring for an ill family member and feared the call may be important information about a loved one. Instead, the caller told the woman her vehicle warranty or registration was out of compliance and she needed to purchase and send gift cards to avoid penalty. The woman wisely realized the call was a scam and hung up, but both she and her husband were surprised the scammers could fake a caller ID. The technology to create a deceptive caller ID has been used in previous scams. Like most law enforcement, calls from the Idaho State Police typically show "No Caller ID".

Remember: any caller threatening you with jail time or another penalty, and wanting payment via gift cards, prepaid debit cards, money transfer apps, etc. is a scammer. Hang up on them immediately.

Craig B. Larsen, 22, of Salmon, ID, was driving northbound in a 2012 Chevrolet Silverado. While negotiating a left curve, Larsen drove off the right side of the roadway. Santiago Rodriguez Reyna, 62, of Marsing, was traveling westbound in a 1995 Ford Ranger. Rodriguez Reyna lost control on the icy road surface, drove off the right shoulder, and rolled into a drainage.

Rodriguez Reyna was transported by ground ambulance to West Valley Medical Center in Caldwell where he succumbed to his injuries.

On December 9, 2020, at approximately 4:42 p.m., Idaho State Police investigated a single-vehicle fatality crash near 371 Spring Cove Road, north of Bliss. A juvenile driver was traveling eastbound on Spring Cove Road in a 2001 Dodge Ram 1500 when the driver failed to negotiate a curve, lost control, and drove off the right shoulder into a plowed farm field. The Dodge continued into a broad slide skid hitting a small embankment before over turning.

The driver was ejected from the vehicle and succumbed to their injuries at the scene. A juvenile passenger was transported by air ambulance to Saint Alphonsus Regional Medical Center in Boise.
Neither occupant was wearing a seatbelt. Next of kin has been notified.

Idaho State Police was assisted on scene by the Gooding County Sheriff's Office and Gooding Fire Department.

On 12/9/2020 at 1:11 P.M., Idaho State Police investigated a crash eastbound US20 at milepost 308, in Idaho Falls.

James Williams, 44, of Meridian was traveling westbound on US20 in a 2009 Mazda 5. Armando Silvas, 27, of Idaho Falls was traveling with Williams as a passenger. Adrian Torres-Valencia, 23, of Kearns, Utah was traveling eastbound on US20 in a 2015 Freightliner. Mathew Jones, 24, of Fort Worth, Texas was traveling with Torres-Valencia as a passenger.

Williams crossed over into eastbound traffic, colliding with Torres-Valencia. Both vehicles came to rest in the westbound lanes of travel. Silvas was ejected from the vehicle. Both Williams and Silvas were transported to Eastern Idaho Regional Medical Center via ground ambulance, neither were wearing seatbelts. Torres-Valencia and Jones were not transported and both were wearing seatbelts.

Idaho State Police was assisted by Idaho Falls Police Department, Idaho Falls Ambulance, Idaho Falls Fire Department, and Idaho Transportation Department. Lanes were fully blocked for approximately two and half hours. The crash is still under investigation by Idaho State Police.

Patricia Ault, 29, of Rupert, was westbound on 600 East in a 2001 Subaru Forrester. The Subaru rolled off the right shoulder of the road, where it came to rest. Authorities believe the crash took place at approximately 2:00 a.m. The crash was not discovered for several hours.

On Wednesday, December 9, 2020, at approximately 10:23 a.m., Idaho State Police investigated a two-vehicle, injury crash westbound Interstate 84 at milepost 236, in Cassia County.

Billy Gill, 37, of Pocatello, was westbound Interstate 84 in a 2017 Kenworth tow truck. Brandon Richins, 41, of Clearfield, UT in a 2017 Kenworth semi-truck pulling a tanker trailer. The semi-truck was merging back onto the Interstate from the right shoulder. The tow truck collided with the back of the tank trailer. Both vehicles came to rest on the right shoulder of the Interstate.

Gill was transported to Portneuf Regional Medical Center in Pocatello by air ambulance. The right lane of travel will be blocked for several more hours for vehicle removal.

The crash is under investigation by the Idaho State Police. They were assisted at the scene by Malta Ambulance, Malta Fire Department, and the Idaho Transportation Department.

A commercial semi-truck was travelling northbound on Interstate 15 when it made an abrupt lane change to exit onto Interstate 86.

Nymewae Friend, 21, of Portland, Oregon, was travelling northbound on Interstate 15, transitioning onto Interstate 86, in a 2002 Hyundai Santa Fe in the left hand lane. Friend swerved to avoid the semi-truck and went into the median where the Hyundai overturned.

Friend was transported by ground ambulance to Portneuf Regional Medical Center. Friend was wearing her seatbelt.

This investigation is ongoing.

Timothy Webster, 56, of Idaho Falls, was travelling northbound on Lewisville Highway in a 2012 Ford Escape. Mark Mikkola, 61, of Idaho Falls, was also travelling northbound in a Ford farm tractor. Webster collided with the rear of Mikkola's tractor.

Webster was transported to Eastern Idaho Regional Medical Center via ground ambulance. The roadway was blocked for approximately one hour.

Idaho State Police recommends to not solely rely on standard tractor lighting only and utilize a rear guard when operating farm equipment on a roadway at night.

Troopers with the Idaho State Police are searching for the driver of a vehicle that went off the road just above Lucky Peak reservoir late this afternoon. A witness saw the vehicle go down the embankment and called for help. However, when emergency responders arrived, the driver had fled. Further investigation revealed the vehicle had previously been reported stolen.

What Happened:
According to a witness, at 4:28 p.m., the driver of a silver Toyota Tundra drove off Highway 21 near milepost 12, just east of Lucky Peak dam. The vehicle came to a stop approximately 800 feet down a steep, dirt embankment.

Idaho State Police are investigating the crash. Troopers are asking the public for information that may help locate the person driving the pickup at the time of the crash. Anyone who witnessed an individual looking for a ride or otherwise leaving that area about 4:30 p.m., or has any other information that would help identify or locate the missing driver, is asked to call ISP dispatch at 208-846-7550.

The report of the stolen vehicle is a separate, ongoing investigation. No further information on the vehicle is available at this time.

On Wednesday, December 2, 2020 at approximately 6:10 a.m., Idaho State Police investigated a single-vehicle, fatality crash westbound I84 at milepost 161, four miles west of Jerome.

Jose Reyes, 25, of Gooding, was westbound in a 2011 Nissan Altima. The vehicle went off the right shoulder and rolled, where it came to rest. Reyes was not wearing a seatbelt. He succumbed to his injuries at the scene of the crash. Next of kin has been notified.

The crash is under investigation by the Idaho State Police.

On Sunday, November 29, 2020, at approximately 10 p.m., Idaho State Police investigated a two-vehicle injury crash at the intersection of Ferry Butte Road and Blackhawk Road in Bingham County.

Eloysa C. Lusk, 24, of Blackfoot, was driving a 2015 Kia OLX northbound on Blackhawk Road when she failed to stop for a stop sign at the intersection of Ferry Butte Road.

Travis L. Henderson, 51, of Blackfoot, was driving a 1998 Ford F150 westbound on Ferry Butte when he was struck on the driver's side by the Kia OLX.

Lusk and her passenger, Samantha J. Zamora, 21, of Burnet, Texas, was transported by ground ambulance to Portneuf Medical Center in Pocatello. Henderson was transported by ground ambulance to Eastern Idaho Regional Medical Center in Idaho Falls. No occupants were wearing their seatbelts.

The intersection was blocked for approximately 2 hours and 40 minutes.

This crash is under investigation by the Idaho State Police.

On November 24, 2020, at approximately 7:45 p.m., the Idaho State Police investigated an injury crash southbound on I15 at milepost 120, about one mile north of the US20 junction in Idaho Falls. Apollo Gromiller, age 19, of McAllister, MT, was driving southbound in a Toyota 4Runner when he went off the road on the left side, overcorrected, and rolled. The vehicle came to rest on the right shoulder and caught fire. Idaho Falls Fire and Idaho Falls Airport Fire personnel responded, put out the fire, and removed Gromiller from the vehicle. He was transported by ground ambulance to Eastern Idaho Regional Medical Center in Idaho Falls. Southbound traffic was blocked for nearly two hours. The Idaho State Police was assisted by Idaho Falls Fire Department, Idaho Falls Airport Fire Department, and Idaho Falls Police Department.

We all have more holidays to enjoy, so Buckle Up, Idaho!

Holiday gatherings may look different this year, but what hasn't changed is the importance of sharing the holidays with loved ones. Idaho State Police are reminding motorists that buckling up and engaged driving is the best way to keep families whole and ensure more holiday celebrations.

Idaho State Police supports a special two-week mobilization involving the ITD Office of Highway Safety and partner law enforcement agencies nationwide. Focused seat belt education and enforcement patrols began November 16 and will run through November 29. During traffic stops, these patrols will provide additional emphasis on the protection and safety seat belts provide.

"Our Troopers see first-hand the lives lost when people don't buckle up, and that sudden loss of life is devastating to the family. The best way we can honor those families is to try and prevent these tragedies. That means getting folks to wear their seat belt and focus on their driving." Said Lt. Chris Weadick of ISP District 6 in Eastern Idaho.

According to the Idaho Office of Highway Safety:

- As of Nov 17, 2020, there have been at least 131* motor vehicle fatalities in Idaho; 88 of those killed were not wearing seat belts.
- In 2019, 44% of the fatal crashes in Idaho were single vehicles that ran off the road; 72% of those killed in these vehicles were not wearing seatbelts.

"The enforcement done in these patrols can often be an effective education for motorists to remember safe driving behaviors, including buckling up." Said Lt Chris Schenck of ISP District 1 in North Idaho.

"We're urging folks who choose to travel this holiday to think of the friends and family and great food they have waiting for them, and to make the choices that will get them where they're going safely. Most folks don't want to risk a citation, but that enforcement can be useful as education to remind folks it's all about getting them down the road and keeping them safe." Said Lt. Schenck.

Funding for additional seat belt education and enforcement is provided by a grant from the Idaho Transportation Department through the National Highway Traffic Administration.

On November 18, 2020, at approximately 7:00 PM, Idaho State Police investigated a commercial vehicle fire, westbound on Interstate 84, just before exit 44, in Meridian.

Tejinderpal Sooch, 39, of Abbotsford, British Columbia was driving westbound on Interstate 84 in a 2017 Freightliner tractor pulling a 2021 Utility van refrigerated trailer loaded with vegetables. Sooch noticed a small fire in his rear view mirror and stopped in the left hand emergency lane. He disconnected the tractor from the trailer before the trailer became fully engulfed in flames.

The left lane of westbound traffic will continue to be blocked until the tow crew completes recovery and cleanup of the semi-trailer.

On Tuesday, November 17th, 2020, at approximately 5:45 PM, Idaho State Police investigated a crash southbound on Interstate 15 at milepost 110, south of Idaho Falls.

A 2006 Honda Civic driven by Pedro Chavez-Carranza, 21, of Idaho Falls, and a 1995 Nissan pickup driven by Clint Underwood, 30, of Blackfoot, were engaged in reckless driving southbound on I15. Chavez-Carranza was tailgating Underwood and flashing his head lights when Underwood slammed on his brakes. The Honda Civic crashed into the back of the Nissan pickup. Both drivers lost control of their vehicles. The pickup went into the median and rolled. The Honda spun out, then came to rest on the right shoulder.

A juvenile passenger from the Nissan pickup was transported via ground ambulance to Bingham Memorial Hospital. The juvenile passenger was in an improperly installed child safety restraint. The adult occupants in both vehicles were wearing seatbelts. Both drivers were cited.

Idaho State Police wants to remind drivers never to engage in reckless driving with another vehicle.

This crash is under investigation by Idaho State Police.

On Friday, November 13, 2020, at 11:12 a.m., the Idaho State Police investigated a one-vehicle fatality crash on I86 at milepost 33, west of American Falls. Kent Gwilliam, 68, of Burley was westbound, on I86 in a 2008 Kenworth truck, pulling a single trailer. Gwilliam's vehicle hit a patch of ice, went off the left shoulder and continued across the median, coming to rest in the eastbound lanes. Gwilliam was ejected from the vehicle and succumbed to his injuries.
Next of kin has been notified.
Seatbelts were not worn.
The eastbound lanes of travel were blocked for approximately 4 hours.

An Idaho State Police investigative team is about to take a deep dive into dozens of cold cases hoping to bring justice to victims.

ISP's Forensic Services (ISPFS) recently received several grants totaling over $750,000 from the Bureau of Justice Assistance, part of the U.S. Department of Justice's Office of Justice Programs to enhance forensic services in Idaho. Approximately $150,000 of the grant money will go to solving cold cases using a new technique called forensic molecular genetic genealogy. The hope is recent advances in applying molecular biology science to genealogy techniques can generate new leads in cases where DNA has been collected from crime scenes but not yet matched to a suspect in existing databases.

"Our goal is to help law enforcement solve cases where we have not been able to find suspects due to limitations in current techniques. Generating new leads on these cases will make Idaho safer by identifying the individuals responsible for these serious crimes," said Matthew Gamette, Director of Forensic Services for the Idaho State Police.

"By helping these investigators identify the perpetrators of these crimes, we will bolster the criminal justice system and find answers for victims who are still hoping for justice."

How the new technique works: DNA profiles from forensic samples currently exist in the National DNA Index from Idaho that have not matched to any potential suspects. Most people are not in the National DNA Index. For example, if an individual has never been convicted of a felony in Idaho, their DNA will not be in the national DNA database. The new technique known as forensic molecular genetic genealogy uses a different type of searching. This technique uses genealogical data from regular consenting citizens put into open-access public databases to identify potential criminals. After a potential suspect has been identified through genetics, DNA from that individual is compared directly against the crime scene sample.

The technique is being used in a growing number of unsolved violent crimes, and recent case studies show the new science can work.

The use of molecular genealogy was facilitated by ISP Forensic Services and helped lead to an arrest and successful prosecution in a 2017 rape case in Teton County. ISPFS featured the case in a public presentation last month during National Forensic Science Week.

"Test cases in Idaho run in the last year have shown the robustness of this technique to identify true perpetrators, exonerate innocent individuals, and bring closure to serious violent crimes. This new grant funding will allow Idaho to address cold cases that could benefit from this technique," said Gamette.

Identifying Cases: An Idaho Molecular Genetic Genealogy (MGG) team has already been established and is meeting to prioritize the first batches of cases to be worked under this project. The MGG team is headed by ISPFS and consists of experienced law enforcement investigators and state forensics lab scientists. The MGG team has already identified over 50 cases that could possibly benefit from this technique and has already started reaching out to local agencies to partner on the investigation of identified cases.

How does the grant money help: The grant money will allow Idaho State Police Forensic Scientists to partner with professional genealogists capable of using molecular biology information in public opt-in genealogy DNA databases.

On Wednesday, November 11, 2020, at approximately 08:32 a.m., Idaho State Police investigated a fatality crash westbound I84 at milepost 231.8, north of Malta.

Wayne Jearls, 78, of Fall Creek, OR, was driving a 1999 Ford F350 pickup pulling a camper trailer westbound I84 at 231.8. Jearls lost control and drove into the median and the vehicle rolled. Jearls' vehicle came to rest on its side blocking the eastbound lanes of travel. Jearls and his passenger, Linda Jearls, 77, of Fall Creek, OR were both wearing seatbelts.

Wayne Jearls succumbed to his injuries on scene. Linda Jearls was transported by ground ambulance to Cassia Regional Medical Center. She was later transported by air ambulance to St. Alphonsus Regional Medical Center in Boise.

Next of kin has been notified. The lanes of travel were blocked for approximately 5 hours. The crash remains under investigation by Idaho State Police. Idaho State Police were assisted by Cassia County Sheriff's Office, Declo Fire Department, Malta Ambulance, Medic One Ambulance and the Idaho Transportation Department.
The Idaho State Police would like to express appreciation for the efforts and assistance provided at the scene by citizen bystanders.

Richard E Morrison, 72, of Spirit Lake, ID, was Northbound on SH41 when he hit a patch of ice and lost control of his green 2004 Ford F150 pickup. The vehicle rolled off the Northbound shoulder, ejecting Morrison. Also in Morrison's vehicle was Kathryn J Morrison, 69, of Spirit Lake, ID.

Neither Morrisons were wearing seat belts. Both were transported to Kootenai Health for their injuries. Investigation is continuing.

Idaho State Police Troopers arrested a Meridian woman this evening after a brief incident on the steps of the Idaho Statehouse.

The incident occurred at 6:00 p.m. as more than 100 people from two separate groups gathered on the Statehouse steps. As Troopers worked to keep the groups separated, a Trooper witnessed a woman reach out and attempt to grab another woman, causing both to fall down approximately three stairs. The Trooper was close enough to quickly try to stop the incident, causing him to also fall.

Arrested: Deisha R. Payne, 19, Meridian
Charged: Assault (m)

Payne was cooperative as Troopers took her into custody immediately following the incident. No one involved appeared injured. Payne was booked into the Ada County Jail on the above charge. A short time later, those assembled began to voluntarily disperse.

Idaho State Troopers remain at the Statehouse to continue to ensure those wishing to exercise their rights to free speech and assembly can do so peacefully.

An Idaho State Trooper stopped a vehicle traveling on Interstate 90 in Kootenai County at approximately 10:00 a.m. yesterday morning after the trooper witnessed a traffic violation. Following further investigation, an occupant of the vehicle was arrested and booked into the Kootenai County Jail on a Deliberate Homicide warrant out of Yellowstone County, Montana.

The man was identified as Benial Davis, 37, of Billings.

As the arrest is in connection to an ongoing criminal investigation, no further information is available from the Idaho State Police at this time. Any further inquires should be directed to the Billings, Montana Police Department.

On 11/03/2020 at about 10:00 AM (PT), members of the Idaho State Police (ISP) stopped a vehicle travelling on Interstate-90 outside of Coeur d'Alene, Idaho. The vehicle was occupied by Benial Davis, a 37 year old male from Billings.

Davis is currently in custody at the Kootenai County Correctional Facility on a Deliberate Homicide warrant for his arrest out of Yellowstone County. The warrant is in relation to the homicide that occurred on 11/01/2020 in the 4100 block of King Ave East.

The investigation remains on-going. BPD Detectives are coordinating investigative efforts with ISP. Any additional information will need to be obtained from charging documents or proceedings for extradition back to Montana.

On November 4th, 2020 at 4:18 am the Idaho State Police investigated a fatality crash eastbound on I90 at milepost 53 near Kellogg. A gold 1998 Nissan Maxima with three occupants was travelling westbound on I90 near milepost 53 when it went into the median and crossed over to the eastbound side. The Nissan entered the eastbound lanes and was subsequently struck by a 2021 Freightliner semi travelling eastbound, driven by Michael Moore, 29 years old of Goldsboro, NC. Two occupants of the Nissan, Tony Allen, 49 years old of Spokane Valley, WA, and Jade Martin, 25 years old of Las Vegas, NV, were ejected from the vehicle. The rear passenger, Jennifer Petek, 37 years old of Suquamish, WA, was trapped in the rear of the vehicle. Allen and Martin were pronounced deceased a short time later by medical personnel. Petek was transported to Kootenai Medical Center. Michael Moore and his passenger, Jibril Moore, 26 years old of Rocky Mount, NC, were not injured. Allen and Martin were not wearing seatbelts, Petek was wearing her seatbelt. The roadway was blocked for six hours. At this time it is unknown whether Allen or Martin were driving the vehicle. The investigation is ongoing.

On November 3, 2020, at approximately 12:39 P.M., the Idaho State Police investigated a single-vehicle fatality crash on State Highway 55 at milepost 118, north of Cascade.

Shaya Lee, 31, of Cascade, was driving southbound on State Highway 55 in a black 2008 Hyundai Elantra. Lee drove off the road way, overcorrected driving back onto State Highway 55, and then off the right shoulder where the vehicle rolled. Lee was not wearing a seat belt.

Lee was transported by ground ambulance to Cascade Medical Center in Cascade. Lee succumbed to her injuries at the hospital.

Next of kin has been notified.

24 DUI arrests from the North Idaho DUI Task Force Halloween weekend;
Troopers: About half of DUI drivers located thanks to citizen calls.

Idaho State Police Troopers noticed two trends during operations of the North Idaho DUI Task Force this past Halloween weekend; first, a notable percentage of DUI drivers with excessively high blood alcohol levels; and second, a large percentage of DUI drivers located thanks to calls from other drivers.

"We work hard to let the public know we're out there and exactly what we're doing, which is looking to get impaired drivers off the road. It's very helpful to see the public support us in that." Said ISP Sgt. Justin Klitch.

The North Idaho DUI Task Force is made up of members from the Idaho State Police, Kootenai County Sheriff's Office, and the Coeur d'Alene, Post Falls, Rathdrum, and Spirit Lake Police Departments.

For Kootenai County, Friday night, October 30 through early Sunday, November 1, the North Idaho DUI Task Force patrols resulted in the following charges;

- 24 DUI arrests
- 5 charged with Excessive DUI, which is a blood alcohol level (BAC) of .20 or higher. In Idaho, it is illegal to drive with a BAC of .08 or more;
- 1 DUI involved a driver under the influence of drugs.
- 1 Injury to a child;
- 1 Minor in possession;
- 2 Open container;
- 6 Misdemeanor drug offense;
- 4 Arrests for outstanding warrants.

Troopers say two other statistics are most gratifying:

- 50% - Estimated percentage of DUI drivers located thanks to reports from other drivers;
- 0 - Zero serious or fatal injury crashes during the Halloween weekend.

"It wasn't that long ago that North Idaho had a very high rate of alcohol-related crashes and local families were being torn apart by it. Today, the rate of alcohol-related crashes in North Idaho has fallen considerably, and we know more families are whole because of that."

Sgt. Klitch credits the enforcement work of the North Idaho DUI Task Force, the involvement of the team's Drug Recognition Experts, and the proactive education the team provides for helping lower the rate of alcohol-related crashes in North Idaho. He's also quick to point out community support for safer roadways.

"We've seen community support for the task force noticeably increase over the three years it's been in existence. We also see residents supporting each other by finding sober, designated drivers, taxis, and rideshares. It's a community effort and it's making a difference." Said Sgt Klitch.

The North Idaho DUI Task Force was established in 2017. During task force operations, there has yet to be a fatal alcohol-related crash in Kootenai County, and the troopers and officers hope to keep it that way. According to national statistics, during Halloween nights from 2013 - 2017, 42% of those killed were in traffic crashes that involved at least one drunk driver.

Funding for extra traffic safety patrols is provided by a grant from the Idaho Transportation Department Office of Highway Safety through the National Highway Traffic Safety Administration.

On Monday, November 2, 2020, at 6:40 p.m., the Idaho State Police investigated a single vehicle injury crash, northbound I-15 at milepost 105.4, south of the Shelley exit in Bingham County.

Alexander Lawhon, 23, of Blackfoot, was driving a 1991 Subaru Legacy northbound on I-15, when his vehicle went off the right shoulder and rolled, coming to rest in a field.

Lawhorn was wearing a seat-belt and was transported by ground ambulance to the Eastern Idaho Regional Medical Center in Idaho Falls.
This crash is under investigation by the Idaho State Police.

On Monday, November 2, 2020, at 4:54 p.m., Idaho State Police investigated a vehicle fire westbound on I86 at mile marker 11, near Raft River.

Clifton K. Robinson, 45, of West Valley, UT, was driving westbound on I86 in a 2003 Peterbilt semi-truck hauling two trailers loaded with straw. The load on the trailer caught fire and burning straw set off a wildfire on the north roadside of I86.

The right lane of travel was blocked for approximately four hours.

Idaho State Police Troopers say Halloween weekend is known as one of the busiest weekends of the year for impaired drivers, and 2020 was no different.

State Troopers partnered with DUI teams from Boise, Meridian, and Nampa Police to provide extra patrols focused on removing impaired drivers from the roadways this Halloween weekend.

"It was a very busy weekend," said ISP Sgt. Curt Sproat.

For the four agencies involved from Ada and Canyon Counties, Friday night, October 30 through early Sunday, November 1:

- 31 DUI arrests;
- 7 Minor in consumption citations;
- 1 Resisting & obstructing charge;
- 1 Felony eluding charge;
- 5 Misdemeanor drug charges;
- 2 arrests for outstanding warrants.

Troopers estimate the number of DUI arrests this Friday and Saturday night is between two and three times a typical weekend.

Still, troopers say they spoke with a number of drivers who were sober and acting as a designated driver. Those drivers received a special gift.

"When we found a designated driver, we were happy to hand out candy and say 'thank you' to them. 31 DUI arrests in two days are way too many, but it was nice to see a good number of sober drivers as well," said Sgt. Sproat.

Troopers would also like to thank the Eggers-Zavala family who joined the patrol briefing Friday night representing Mothers Against Drunk Driving. They shared with officers the lasting tragedy an impaired driver inflicted on their family and thanked all those on patrol for their lifesaving efforts.

"We can't know what we may have prevented. We do know impaired driving poses a serious danger to everyone on the road, and we believe more people are safe and sound today for the efforts of the Troopers and Officers this weekend," said Sgt. Sproat.
