Defendant Sentenced to Twenty-Four Years for Murder on Nez Perce Reservation

COEUR D'ALENE - Raymond Antoine Scott, Jr., 39, of Lapwai, Idaho, was sentenced today in United States District Court to 288 months in prison for second degree murder in the death of William Reich on the Nez Perce Reservation, U.S. Attorney Wendy J. Olson announced. Chief U.S. District Judge B. Lynn Winmill also ordered Scott to serve five years of supervised release and to pay a $250,000.00 fine. Scott pleaded guilty to the charge on May 4, 2015.

According to the plea agreement and statements during court, Scott admitted that he intentionally and with malice killed William Reich on July 9, 2013. Scott admitted to using a hatchet or similar object to strike Reich in the head. The case was handled by the United States Attorney’s Office because it happened on the Nez Perce Indian Reservation and both Scott and Mr. Reich were tribal members.

Olson said that Scott earned every day of his twenty-four year sentence. “This defendant’s criminal history demonstrates that he has injured and harmed people both on and off the reservation,” said Olson. “The victim in this case, William Reich, was a kind man who deserved a far better fate. There is nothing that my office can do to lessen the pain for the family of Mr. Reich or his community. However they can rest assured that Raymond Scott, Jr. will not be able to harm other members of the community for many years to come. I appreciate the collaborative efforts of the tribal, state and local law enforcement agencies in bringing this defendant to justice.”

The case was investigated by Federal Bureau of Investigation (FBI), Nez Perce Tribal Police and the Idaho State Police.

Four Defendants Arrested in Multi-County Meth Distribution - Fifth Defendant Remains at Large

BOISE - Miguel Angel Dorantes, 18, Alberto Lopez, 18, Elizabeth Baeza, 18, Sobeida Galaviz, 24, all of Hailey, Idaho, and Leonel Angel, 20, of Compton, California, were indicted on July 14, 2015, by a federal grand jury in Boise for one count of conspiracy to possess controlled substances with intent to distribute, eleven counts of possession with intent to distribute methamphetamines, and eight counts of distributing a controlled substance near a school, U.S. Attorney Wendy J. Olson announced. An initial appearance was held on July 21, 2015, for four of the defendants. Defendant Dorantes has not yet been found or arrested.

The Indictment alleges that between March 23 and May 28, 2015, the defendants were involved in possessing methamphetamine with intent to distribute it in Blaine County, Lincoln County, and Jerome County. Four of the drug transactions are alleged to have occurred within 1,000 feet of Hailey Elementary School in Hailey, Idaho, and four of the transactions are alleged to have occurred within 1,000 feet of Heritage Academy in Jerome, Idaho.

The penalties for the charges vary—depending on the facts for each charge—from not more than five years in prison, to not less than ten years mandatory minimum up to life. Distributing controlled substances within 1,000 of a school doubles the penalty for the amount of controlled substance distributed. The maximum fine for each of the charged offenses varies from $1,000,000 to $5,000,000. The number of years of supervised release following any incarceration for the charged offenses varies from three years to five years.

A trial is set for September 28, 2015, before U.S. District Judge B. Lynn Winmill at the federal courthouse in Boise.

The case is being investigated by the Bureau of Alcohol, Tobacco, and Firearms, Idaho State Police, Blaine County Sheriff’s Office, Lincoln County Sheriff’s Office, Jerome County Sheriff’s Office, Twin Falls Police Department, and Hailey Police Department.

An indictment is a means of charging a person with criminal activity. It is not evidence. The person is presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

Montana Man Sentenced for Illegally Possessing Firearms

COEUR D'ALENE  - Jesse Carey Barker, 31, of Roll, Arizona, was sentenced Tuesday to 48 months in prison for possession of firearms by a prohibited person, U.S. Attorney Wendy J. Olson announced. Visiting U.S. District Judge William Fremming Nielsen also ordered Barker to serve three years of supervised release and to forfeit the firearms.

According to the court documents, on October 7, 2013, Barker was stopped for driving under the influence. Officers were able to see a rifle with a bayonet attached to it in plain view through the car window. After completing field test, a vehicle search was completed and a loaded handgun was located under the passenger's front seat beside an open beer. It was also determined that the rifle was loaded.

The case was investigated by Idaho State Police (ISP).

TWIN FALLS - Idaho State Police will display and open its Mobile Command Center for tours by public safety agencies and the public on Tuesday, July 14th from 1:00 p.m. to 3:00 p.m. at the Twin Falls Visitor Center located at 2015 Neilsen Point Place in Twin Falls. A brief presentation will take place beginning at 1:00 p.m.

The ISP Mobile Command Center (MCC) is a trailer designed to meet incidents classified by the Federal Emergency Management Agency as Type 2. These incidents are those that extend beyond the capabilities for local control and that are expected to continue for multiple operational periods. A Type 2 incident may require the response of resources out of area, including regional and/or national resources, to effectively manage the operations, command, and general staffing of an incident.

The MCC is a self-contained unit with a generator and is used as a communications asset, as well as a command coordination center. It is equipped with public safety radio equipment, dispatch consoles, telephones and computer equipment. ISP has deployed the MCC for pre-planned events and special operations throughout Idaho. It is also utilized for emergency response incidents including hazardous material spills, weather-related emergencies, natural disasters, search and rescue or hostage/stand-off situations.

The MCC is staffed by communications officers from ISP's two regional communications centers in Meridian and Coeur d'Alene.

"Officer on a Train" Operation in Bonneville, Jefferson and Madison Counties on Monday in Cooperation with Operation Lifesaver

IDAHO STATE POLICE NEWS RELEASE
Teresa Baker
Public Information Officer
Headquarters
700 S. Stratford Dr., Meridian 83642
(208) 884-7122
Fax (208) 884-7087

For Immediate Release: 7/10/15 at 11:20 a.m.

IDAHO FALLS - The Idaho State Police along with local law enforcement will be conducting "Officer on a Train" and "Adopt a Crossing" enforcement operation in Bonneville, Jefferson and Madison counties on Monday, July 13th. The dedicated patrols are in cooperation with Idaho Operation Lifesaver, Eastern Idaho Railroad, the Bonneville, Jefferson and Madison County Sheriff's Offices and the Rexburg Police Department.

"State and local law enforcement are once again participating in this important operation with a goal to increase public awareness of the potential dangers that exist at railroad intersections that can have tragic consequences," said Idaho State Police Lt. Chris Weadick. "We hope that by letting the public know that we are focusing on enforcing the traffic laws that pertain to these intersections that drivers, as well as, pedestrians, will always be more careful near railways."

During the "Officer on a Train" enforcement effort, one officer rides in the lead locomotive of a train as a spotter. This officer observes traffic approaching the rail intersections as the train proceeds down the tracks. Other law enforcement officers pace the train or are parked at specified locations. When a motorist is observed violating the laws pertaining to approaching a rail intersection, the officer on the train radios the nearest patrol car, with the information. That officer will stop the motorist, explain the dangers and issue a citation, if warranted.

"Adopt a Crossing" will also take place on Monday. Officers and troopers will pick a rail crossing within their jurisdiction and focus on enforcing the laws that pertain to that crossing.

Thus far in 2015, there have been 4 vehicle/train collisions in Idaho. Surprisingly, there were no injuries or deaths in those crashes. In 2014, there were 20 vehicle/train collisions resulting in one fatality along with two pedestrians who were killed while on train tracks.

Tips for crossing tracks safely:

- Always expect a train on any train track, at any time.
- Slow down as you approach all railroad crossings and be prepared to stop if necessary.
- Never drive around lowered gates - it's dangerous and illegal.
- Proceed through a crossing only if you are sure you can completely clear it without stopping.
- Trains can't stop quickly because of their size and weight.
- Don't stop on the tracks, it's illegal.
- If you suspect a signal is malfunctioning, call the number posted on or near the crossing signal, local law enforcement or Idaho State Police at *ISP (*477).
- If you find yourself in the path of a train, get out of the way, and if your vehicle is stuck, immediately get out of the vehicle and away from the tracks.
